Terms of service

These terms are a contract between you and Ilhan Akbudak, trading as UniChat Games ("UniChat Games", "we", "us"), the company that makes and operates SKYWARD. They cover the game, everything in it, and any service we run behind it, leaderboards, cloud saves, accounts and support.

Please read them. If you do not agree to them, do not play: the game asks you to accept these terms and our Privacy Policy before it creates an account for you or starts a run, and there is no way around that on purpose.

1. Accepting these terms

You accept these terms by tapping Agree and continue on the screen the game shows before your first climb. That tap is recorded on your device with the version you accepted and the date, and you can see it again at any time under Settings → the line under Terms and Privacy.

If we change these terms in a way that matters, what you are agreeing to, what we collect, what we may do with your account, we will show you the screen again and ask you to accept the new version. Small corrections that change nothing about your rights will not interrupt you.

2. Who may play

You must be 13 or older to play SKYWARD.

If you are under the age of majority where you live, you may only play with the permission of a parent or guardian, and by playing you confirm you have it. If you are a parent or guardian and you believe a child under 13 has been playing with an account, write to privacy@unichat.dev and we will delete the account and its data.

We do not knowingly collect anything from anybody under 13. SKYWARD is not directed to children and is not listed in the App Store's Kids Category.

3. Your account

SKYWARD gives every installation an account automatically. You never have to sign up, and there is nothing to remember.

  • The automatic account belongs to the app on that device. If you delete the app, that account becomes unreachable, including by us, and the progress on it is gone.
  • Game Center, if your device is signed in to it, gives you a durable account instead: your progress survives deleting and reinstalling the app, and follows you to another device signed in to the same Apple Account.
  • Sign in with Apple, in Settings, does the same thing deliberately rather than automatically, and is the option if you have Game Center switched off.

You are responsible for what happens on your account. Do not share it, sell it, buy one, or try to take someone else's. We may suspend or close an account that is being used to break these terms.

4. Playing fairly

While you play SKYWARD, you agree not to:

  • modify the game, its files or its memory, or run it through anything that does;
  • use bots, macros, emulators or automated input to play for you or to farm rewards;
  • exploit a bug for advantage instead of reporting it, if you find one, please write to us;
  • interfere with our servers, try to reach data that is not yours, or test our security without our written permission;
  • choose a display name that is abusive, hateful, sexual, deceptive or impersonates somebody else;
  • copy, decompile, reverse-engineer or redistribute any part of the game, except where the law gives you that right regardless of this clause.

Leaderboards are verified. When you post a score, the game sends the run's inputs and we re-play the run on our own servers to check that the result is one the game could actually produce. A score that does not reproduce is removed, and the account that posted it may be suspended. This is also why we ask you not to modify the game: a modified client produces runs that fail this check even when nobody meant to cheat.

5. Coins, gems, lives and other virtual items

Virtual items in SKYWARD, coins, gems, lives, boosters and anything else you earn or buy, are a limited, personal, non-transferable licence to use them inside the game. They are not your property, they are not money, they have no value outside the game, and they cannot be exchanged for anything outside it.

  • We may add, change, remove or rebalance items, prices and rewards. Games are tuned after they ship, and a balance change is not a taking of your property.
  • Unused items expire when your account is closed or the game is discontinued, and are not refundable at that point.
  • You may not sell, trade or gift items or accounts, or buy them from anybody but us through the App Store.

6. Payments and refunds

All purchases are made through Apple's App Store using your Apple Account. We never see or hold your payment details, Apple processes the payment and tells us only that a purchase was made and which product it was.

Purchases are delivered as soon as Apple confirms them and are, as a rule, final. Requests for a refund go to Apple, through reportaproblem.apple.com, because Apple is the merchant of record and we cannot reverse a charge we did not take.

None of this removes a right the law gives you. If you are a consumer in the EU, the UK or anywhere else with a statutory withdrawal or refund right, that right applies. For digital content delivered immediately, the EU right of withdrawal usually ends when delivery begins with your consent, which is what happens when you confirm a purchase, but where it survives, we will honour it.

If Apple reverses a purchase, we may remove the items it paid for.

7. The game itself

Everything in SKYWARD, the code, the art, the music, the writing, the name and the logos, is ours or is used with permission. Third-party assets we use under open licences are credited in the game, under Settings → Credits and licences.

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play SKYWARD on devices you own or control, for your own entertainment. That is the whole of the licence: nothing here gives you rights to our trademarks, our source, or our assets, and you may not use them commercially, including in videos that are monetised primarily by our content rather than by your own commentary.

Ordinary let's-plays, streams, screenshots and clips are welcome and you do not need to ask.

8. Feedback

If you send us an idea, a bug report or a suggestion, we may use it without owing you anything for it. We are not asking you to send confidential material and you should not.

9. Availability, updates and ending the service

We do our best to keep SKYWARD up, and we do not promise that it always will be. Servers go down, Apple changes things, and features are sometimes removed because they did not work.

  • We may update, change or remove parts of the game at any time.
  • We may end the service. If we do, we will give at least 30 days' notice in the game or by email where we have one, and we will stop selling anything that could not be used before it closes.
  • You can stop playing whenever you like, and delete your account from Settings → Delete my account. Deleting your account removes your progress, your leaderboard entries and the data described in the Privacy Policy, and it cannot be undone.

10. Disclaimers and liability

SKYWARD is provided as is. To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or free of loss of progress, although we work hard at all three, and a lost save is a bug we want to hear about.

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost virtual items, progress or profits. Where we are liable, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim or €50.

Nothing in these terms limits liability that cannot be limited, including liability for death or personal injury caused by negligence, for fraud, or under any consumer protection law that applies to you. If you are a consumer in the EEA or the UK, you keep every statutory right you have, and the paragraphs above apply only so far as that law permits.

11. Law and disputes

These terms are governed by the law of Türkiye, and the courts of Türkiye have jurisdiction, except that if you are a consumer, you may also bring proceedings in the country where you live, and the mandatory consumer law of that country applies to you regardless of this clause.

Before going to court, please write to us. Most things are a misunderstanding and we would rather fix it.

12. The rest

  • If any part of these terms turns out to be unenforceable, the rest still stands.
  • Not enforcing something once does not waive it.
  • We may transfer these terms to a company that acquires the game; your rights do not change.
  • These terms and the Privacy Policy are the whole agreement between us about SKYWARD.
